Welcome to Forming Habits. These Terms of Service (“Terms”) govern your access to and use of the Forming Habits website (https://forminghabits.com) and mobile application (collectively, the “Service”). By using the Service, you agree to be bound by these Terms.

1. Eligibility

By using Forming Habits, you represent that you are at least 13 years of age. Our Service is not intended for, nor directed at, individuals under the age of 13. If we learn that a user under 13 has created an account, we will terminate that account immediately.

2. User Accounts

  • Registration: You may access the Service by logging in via Apple, Google, or your email address.
  • Account Security: You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately of any unauthorized use of your account.
  • Accuracy: While we do not “collect” personal info in a traditional sense beyond login data, you agree that any info you provide (like an email for newsletters) is accurate.

3. Use of the Service & Permissions

  • App Permissions: The mobile app may request access to your Camera and Photo Gallery. This is strictly to enable app features (e.g., progress photos). You retain all rights to the photos you upload.
  • Prohibited Conduct: You agree not to:
    • Use the Service for any illegal purpose.
    • Attempt to hack, reverse-engineer, or disrupt the Service.
    • Upload content that is offensive, defamatory, or violates third-party rights.

4. Intellectual Property

All content, features, and functionality of the Service—including but not limited to text, graphics, logos, and software—are the exclusive property of Forming Habits and are protected by United States and international copyright and trademark laws.

5. No Payments or Professional Advice

  • No Payments: The Service does not accept or process online payments. Any “premium” features mentioned in the future would require an update to these Terms.
  • Informational Purposes Only: Forming Habits is a tool for self-improvement. We do not provide medical, psychological, or professional health advice. Use of the Service is at your own risk.

6. Third-Party Services

Our Service integrates with third-party providers (Apple, Google) for authentication and uses tracking technologies for analytics. We are not responsible for the availability or practices of these third parties.

7. Limitation of Liability

To the maximum extent permitted by law, Forming Habits and its owners shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of (or inability to use) the Service. The Service is provided on an “AS IS” and “AS AVAILABLE” basis.

8. Termination

We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the “Effective Date.” Your continued use of the Service after changes are posted constitutes acceptance of the new Terms.
